This is to inform you that due to a lapse in appropriations, otherwise known as a government shutdown, the Federal Judiciary has shut down. As a result of the shutdown, a sovereign act of the government, neither the Judiciary nor the contractor will be able to fulfill their obligations under the contract. Therefore, performance under the contract cannot continue until funds have been appropriated and the shutdown has ended.
This notice is not a Stop Work Order within the context of Vol 14, Appx 1B, Clause 2-60, Stop Work Order, or under Federal Acquisition Regulation (FAR) 42.1303. Instead, this notice informs the contractor that it will not be able to continue work due to the shutdown and cannot resume work until funds have been appropriated and the shutdown has ended. We do not know how long the shutdown will last. Furthermore, the Judiciary will not compensate the contractor for any costs it incurs due to the lapse in appropriations.
