Counsel may contact the Court, including the courtroom deputy and/or the law clerks, about procedures specific to Judge D’Angelo. The Court will not answer questions regarding substantive matters pertaining to the case or procedures that are otherwise governed by the Federal Rules of Civil Procedure and/or the Local Rules for the Southern District of Florida. Likewise, the Court will not provide advice on legal questions. Absent a true emergency, counsel of record shall not contact the Court to ask questions concerning the status of pending matters. When contacting the Court, please be ready to provide the case number and presiding Judge so that we may appropriately assist you. Except for any confidential statements submitted pursuant to the Court’s Order Scheduling Settlement Conference, any communications via email should copy all counsel of record or any pro se parties, as applicable. Any proposed orders can be sent via email to DAngelo@flsd.uscourts.gov.
Please refer to Administrative Order 2018-79 for the Court’s policy for bringing audio/visual equipment, mobile phones, and personal devices into the courtroom. Always check the Court’s website for any updates or changes to the Court’s general policy on that matter. Parties seeking to bring electronic equipment into court for use in a courtroom proceeding shall also comply with Administrative Order 2018-79. Motions to admit electronic equipment must be filed at least 72 hours in advance of the hearing or trial. It is strongly recommended that counsel test out the equipment in the courtroom in advance. To do so, counsel may contact the Court to schedule a test of the electronic equipment 24 hours in advance of the hearing or trial.
The Court takes seriously its obligation under Federal Rule of Civil Procedure 1 to “secure the just, speedy, and inexpensive determination of every action and proceeding.” In cases where the presiding District Judge refers all pretrial discovery matters to Judge D’Angelo, the Court will issue a standing discovery order with specific discovery procedures for use in the event of a discovery dispute. The Court expects parties and their counsel to be professional and cooperative in all discovery matters.
Sample Discovery Procedure Order
Ordinarily, only one lawyer for each party may argue at the discovery hearing. Nevertheless, the Court has a strong commitment to supporting the development of our next generation of lawyers. The Court encourages parties and senior attorneys to allow less-experienced practitioners the opportunity to argue in court. If a lawyer of five (5) or fewer years of experience will be arguing the matter, a party should advise the Court prior to the beginning of the hearing. In that event, the Court will allow multiple lawyers to argue on behalf of that party. Please ensure that the appropriate Notice of Appearance has been filed before the hearing.
