The Plaintiff, Robert Schuller, has filed a civil-rights complaint under 42 U.S.C. § 1983, alleging that the Defendant, Dr. Alain Diaz, was deliberately indifferent to his medical needs under the Eighth Amendment. Since March 2023, Schuller complained of neck swelling and pain, which he attributes to a chicken bone that, he says, has been stuck in his throat since November 2022. The Defendant—a doctor employed at Everglades Correctional Institution—has twice refuted Schuller’s complaints, but Schuller avers that the Defendant intentionally falsified his diagnosis and failed to alleviate Schuller’s pain or provide his “next step in [his] plan of care.” Because of the Defendant’s deliberate indifference, Schuller claims he is in “tremendous pain,” which he describes as a “knife in [his] throat and left ear drum.” Schuller will be seeking damages.
