Nadeau v. Brickell Brokers LLC et al (24-CV-23907-RKA) Posted 11/01/2024

The Plaintiff, JonPaul Marcel Nadeau, has filed a copyright-infringement claim under the Copyright Act, 17 U.S.C. § 106, alleging that the two Defendants—a real estate brokerage, Brickell Brokers LLC, and an agent at the brokerage, Ricardo Rafael Suarez—violated his exclusive rights to a photograph (the “Work”). Nadeau alleges that the two Defendants copied Nadeau’s copyrighted Work from the internet to advertise, market, and promote their business activities. Nadeau claims that he owns a valid copyright to the Work and registered it pursuant to 17 U.S.C. § 411(a), and he avers that, in the scope of their business activities, the Defendants willfully copied, displayed, distributed, and made derivatives of the Work without Nadeau’s authorization. The Plaintiff maintains that he has been damaged. He is now seeking a preliminary and permanent injunction, actual damages, the Defendant’s profits (or statutory damages), attorneys’ fees, costs, and pre- and post- judgment interest.
