Marshall v. BK7 Restaurants LLC et al (24-CV-80566-DMM) Posted 10/10/2024

Plaintiff is a fifty-nine-year-old woman suffering from plantar fasciitis, claiming her former employers engaged in workplace harassment on account of her age and disability in violation of the Civil Rights Act of 1964 and the Americans with Disabilities Act. Plaintiff was granted leave to proceed in forma pauperis and the U.S. Marshals Service has served summons on all defendants. Two of the defendants failed to respond to the Complaint and a clerk’s entry of default has been entered. The third defendant has yet to file an Answer and the deadline is upcoming. Given the posture, this case has not been set for trial nor has a Pretrial Scheduling Order been entered. Plaintiff has a current deadline of October 18, 2024, to file a motion for final default judgment against the two defaulted defendants, however the court will be amenable to extending that date if Plaintiff acquires counsel.
