This action is filed by Douglas Lewandowski pursuant to, inter alia, 15 U.S.C.§ 6851 for Nonconsensual Disclosure of an Intimate Visual Depiction. The Complaint asserts that in or around November 2021, Plaintiff Lewandowski and Defendant Bremen Menelli a/k/a Genisley Espindula (“Menelli”) met at a gay pride event in Palm Springs, California where they had sex and recorded a video of their encounter using Menelli’s cell phone. According to the Complaint, Lewandowski asked Menelli to not share the Video with anyone and Menelli expressly agreed he would not do so. Nevertheless, Menelli allegedly published the Video on OnlyFans, an online paid subscription platform popular with adult content creators, without Plaintiff’s knowledge or consent. Menelli seeks pro bono services.
The action is in its beginning stages. Menelli filed an answer to the Complaint when he still had counsel. [DE 50]. Plaintiff has moved to strike the affirmative defenses asserted therein. [DE 56].
