Johnson et al, v. Secretary of Florida Department of Corrections et al (23-cv-23021-RKA) Posted 11/01/2023

The Plaintiffs, Otha Kenyua Johnson and Matthew Lewis, have filed a civil rights complaint under 42 U.S.C. § 1983 against the Florida Department of Corrections and the Warden of the South Florida Reception Center. Both of the Plaintiffs are currently being treated for their opioid-use disorder with the drug “buprenorphine.” According to the Plaintiffs, the Defendants will refuse to continue this treatment for non-medical reasons once the Plaintiffs are remanded into their custody, which the Plaintiffs claim is a violation of the Eighth Amendment of the Constitution and Title II of the Americans with Disabilities Act of 1990.
