How to file sealed documents in a criminal case?

Category:
CM/ECF
Answer:

To file sealed documents in a criminal case, follow these steps:

  1. Submit a Motion to Seal: Pursuant to Local Rule 5.4(b)(1), begin by submitting a motion to seal along with a proposed order, using the event “Motion to Seal (Public)”. Please note: DO NOT attached the sealed documents you wish to file; only submit the motion to seal itself.
  2. Select the CORRECT PARTY: When filing your motion, make sure to only select the applicable DEFENDANT(s) case(s) associated with your motion. Do not select the master case unless it is necessary.
  3. Submit a Proposed Order by Email to the Judge: For proposed documents, the filer must submit the final version of the proposed order by email in Word format (not PDF format).
  4. Filing After Approval: If the court approves your motion, you may then file any authorized pleading, motion, memorandum, or other documents under seal. Use the CM/ECF system and choose the appropriate events designated for your sealed filing: “Sealed Document (Restricted)” or “Sealed Motion (Restricted).”
