Plaintiff, Earl Frank Yearicks IV, has filed a civil rights complaint under 42 U.S.C. § 1983 against Miami-Dade County, the Miami-Dade Police Department, and several law enforcement officers. Plaintiff alleges violations of his Fourth, Fifth, Eighth, and Fourteenth Amendments based on an incident in March 2020 in which he was arrested by law enforcement officers and charged with resisting arrest without violence when officers encountered Plaintiff in a vessel anchored in a sandbar during the time that Florida Governor’s Executive Order No. 20-68 was in effect. Plaintiff alleges that law enforcement officers rammed his body with a boat and “detained, arrested, tortured, and berated” him. The case is not set for trial at this time. The case originated in the Eleventh Judicial Circuit of Florida and was removed by Defendant Miami-Dade County to this Court. Plaintiff has since filed a Second Amended Complaint.
