Notice – Increased Fees for Filing New Civil Cases – Effective May 1, 2013

Effective May 1, 2013, there is a new $50 general administrative fee for filing a civil action, suit, or proceeding in a district court. This fee is in addition to the existing civil filing fee of $350. Therefore, effective May 1st the total fee for filing a new civil case will be $400.

This new fee is part of the “District Court Miscellaneous Fee Schedule”, established by the Judicial Conference of the United States, pursuant to 28 U.S.C. § 1914.

The $50 administrative fee does not apply to miscellaneous civil cases; habeas corpus cases; or to cases filed by pro se prisoner plaintiffs who have been provisionally granted permission to proceed in forma pauperis under 28 U.S.C. § 1915.

CM/ECF Attorney Training Now Available Remotely (posted 01/04/12)

Effective January 3, 2012, attorneys may satisfy the CM/ECF training requirement in the Southern District of Florida by completing an on-line computer based course from their office or home.   This computer training course provides attorneys with an alternative to the hands-on training which requires travel to either the Miami or West Palm Beach courthouses.  Paralegals, legal assistants, IT staff, or other non-attorney support staff who are involved in the electronic case filing process are also encouraged to complete the computer based training. 

The computer based training modules are interactive and provide step-by-step instructions regarding opening new civil cases electronically and filing documents via the CM/ECF system.  Closed caption is available as an option.   The training course consists of 5 modules and can be completed in approximately 2 hours.  Upon completion of the course, attorneys will receive a CM/ECF login and password via email within 3 business days and will then be able to start filing via CM/ECF.  CLE credit is not available for attorneys who complete the computer based training. Important:  All 5 modules must be completed in the same session.  If you exit the session (i.e., close your browser) before you have completed all of the modules, you will be required to start the session again from the beginning.  Also, your computer must be equipped with a Javascript enabled browser; and Internet Explorer 7-8 or Firefox 3.5-3.7 (Mozilla), which are the same browsers that have been tested and are compatible with CM/ECF.

With the availability of the computer based training from remote locations, the hands-on training currently provided at courthouse locations will only be offered a couple of times per month.  In addition, attorneys will no longer be able to satisfy the CM/ECF training requirements by certifying they have attended training in another District.
