This is an action for declaratory judgment. Plaintiff insurance company seeks a declaration that its policy does not provide coverage for an underlying tort action filed by Defendant against Plaintiff’s insured in Florida state court. Defendant is unrepresented in this declaratory judgment action. The underlying state court tort action arises from an assault of Defendant while on Plaintiff’s insured’s property.
