Plaintiff, an inmate in the custody of the Florida Department of Corrections (FDOC) currently housed in the Apalachee Correctional Institution West, filed a Complaint under 42 U.S.C. § 1983, alleging violation of the First Amendment and The Religious Land Use and Institutionalized Persons Act (RLUIPA) by the FDOC. Specifically, Plaintiff, who professes to be a devout Muslim, alleges that the FDOC’s grooming policy preventing him from growing a fist-sized beard forces him to engage in conduct that seriously violates his religious beliefs. The Court has allowed Plaintiff’s RLUIPA claim to proceed, a trial date has been set, and competing Motions for Summary Judgment by the Parties are pending before the Court.
